Contest Rules

1. NO PURCHASE NECESSARY TO ENTER OR WIN.The Wilson Farms, Inc., Coca-Cola Bottling of Buffalo, New York, and Thunder of Niagara” Air Show “Win a Ride of a Lifetime on a War Bird” ("Promotion") begins at 12:01 AM Eastern Time ("ET") on Saturday, July 14, 2007 and ends at 11:59:59 PM ET on Saturday, August 4, 2007 (“Entry Period”).

2. ELIGIBILITY:The Promotion is open only to legal residents of New York State. Entrants must be 18 years of age or older at the time of Promotion registration and meet weight, height, and age restrictions for the airplane ride. Employees, officers and directors of Wilson Farms, Inc., Coca-Cola Bottling of Buffalo, New York, and the Executive Committee of the “Thunder of Niagara Air Show”, their respective parent companies, affiliates, subsidiaries, agents, distributors, suppliers, advertising, promotional, judging, fulfillment and marketing agencies, their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Promotion. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.

3. CONDITIONS OF ENTRY:No purchase necessary to play. LIMIT one (1) entry per person per week during the Entry Period. Subsequent entries in the same week from the same person or email address are void. Any attempt by a person to use multiple email accounts to enter more than once per week are void. Proof of e-mailing does not constitute proof of delivery. By entering, entrants accept and agree to these Official Rules including all eligibility requirements. All entries become the property of Sponsor. Neither Sponsor, nor their respective parent companies, affiliates, subsidiaries, agents, distributors, suppliers, advertising, promotional, judging, fulfillment and marketing agencies, nor the affiliates, subsidiaries, divisions, advertising and promotion agencies, and respective employees of each (collectively “Sponsor Parties”), assume any responsibility for late, lost, illegible, misdirected, or undelivered entries or registration forms.

4. ENTRY PERIODS:The entry period for online registrants begins at 12:01 AM Eastern Time ("ET") on Saturday, July 14, 2007 and ends at 11:59:59 PM ET on Saturday, August 4, 2007.  The entry period for in-store registrants begins at 12:01 AM Eastern Time ("ET") on Saturday, July 14, 2007 and ends at 11:59:59 PM ET on Saturday, August 4, 2007.

5. HOW TO PLAY THE GAME: No purchase necessary to play.

All you need to do is write your name, age and phone number on your Wilson Farms’ receipt and drop it in the Coca-Cola promotions’ box at any of the Wilson Farms stores.  Winning entrants will be notified by phone. All prize redemptions must be claimed by 11:59:59 PM ET on Monday, August 6, 2007. All prize claims are subject to verification by Sponsor. Entries may also be submitted at any participating Wilson Farms, Sugar Creek, and Wilson Farms Xpress locations.

Returning Entrants: Entrants may enter the Promotion online once.  Entrants may also submit subsequent entries at the Coca-Cola displays in participating Wilson Farms, Sugar Creek, or Wilson Farms Xpress locations but are limited to one entry per week.

7. GAME PRIZES AVAILABLE and ODDS OF WINNING: There is a total of eight (8) available prizes in the sweepstakes. Odds of winning prizes depend on the number of eligible entries received. The Quantity, Prize Description/Average Retail Value (ARV) of a specific prize in the “Win a Ride of a Lifetime on a War Bird” is as follows: two (2) rides (1 ride per person) on a vintage war bird airplane that will be appearing at the “Thunder of Niagara” air show, value of each ride is $500.  The winner will have to be available sometime on August 9-10, 2007 for the grand prize airplane ride.  The ride will take place at the Niagara Falls, New York airport; specific arrangements will be made between winner and Sponsor.  There will be six (6) 2nd place prizes that will consist of a pair of Sponsor/VIP tickets to attend the “Thunder of Niagara Air Show” on Saturday, August 11, 2007.  Rain date is Sunday, August 12, 2007.  The value of these tickets is $250.00 per pair.  Total value of contest prizes is $2500.00.

IN THE EVENT OF PRIZE UNAVAILABILITY, PRIZES MAY BE SUBSTITUED BY THE INDEPENDENT JUDGES FOR ITEMS OF EQUAL OR GREATER ARV.

8. PRIZE AWARDING:Prizes will only be awarded by Sponsor upon potential winners’ verification and final approval by Sponsor. No prize substitution, cash equivalent of prizes, transfer or assignment of prize permitted, except by Sponsor in its sole discretion. Any taxes, fees, or incidental costs including but not limited to income taxes which may arise and be due or asserted on account of the prize shall be the sole responsibility of the winner. A 1099 tax form will be the responsibility of the winner. Winners agree that receiving a prize grants Sponsor the right to print, publish, broadcast, and use universe-wide in any media now known or later developed at any time or times, the winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other communications without additional compensation, except where prohibited by law. All decisions of the judges shall be binding and final.

Entries will be deemed made by the authorized account holder of the email address submitted at time of entry. In the event of a dispute regarding the identity of any potential winner, the potential winner will be deemed to be the authorized account holder of the email address submitted at time of entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner must provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the potentially winning Promotion entry. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted. By entering the Promotion, entrant recognizes and agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at http://www.wilsonfarms.com/privacy.php

Winner of the “Ride of a Lifetime on a War Bird” will have to abide by the rules and policies set by the pilot of the aircraft such as weight, height, and age restrictions.  Winner must be in “good health” in order to ride in the airplane.  As stated earlier, winner of the airplane ride will be contacted by the Sponsor to make sure winner meets these requirements and to schedule the actual airplane ride.

Winner of the Sponsor/VIP tickets to the “Thunder of Niagara” air show will have to abide by the Niagara Falls Air Reserve Station’s security policies at the air show.  These policies are available at the air show’s web site which is

9. ENTRY PERIODS: This promotion is being conducted thirty five (35) days.

10. RELEASE: As a condition of entering the Promotion, entrant (agrees that (1) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (2) all causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form class action; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees. BY ENTERING THE PROMOTION, ENTRANTS AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS SPONSOR PARTIES AND THE RESPECTIVE OFFICERS, DIRECTORS, AND AGENTS OF EACH, FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO OR ARISE OUT OF PARTICIPATION IN THE PROMOTION OR ANY PORTION THEREOF, OR THE ACCEPTANCE, USE/MISUSE OR POSSESSION OF PRIZES, OR ANY PRIZE RELATED ACTIVITY. ENTRANTS WAIVE ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. DISCLAIMER: Sponsor Parties are not responsible for printing or typographical errors in any Promotion-related materials. Sponsor reserves the right, in its sole discretion, to disqualify any individual that tampers with the entry process, and terminate, suspend, cancel or modify the Promotion and award the prizes from among all eligible entries received as of the date of termination if for any reason this Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, fraud, unauthorized intervention, technical failures or other causes beyond the control of Sponsor Parties. Sponsor Parties and the respective officers, directors, agents and employees of each are not responsible or liable for any events beyond the control of the Sponsor, which may cause the Promotion to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, nor are they responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion. The Sponsor and its independent judging organization may stop you from participating in this Promotion if you ignore the Promotion Official Rules or act, in Sponsor’s sole discretion: (a) in a manner Sponsor determines to be not fair; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor, (c) do not meet the security requirements at the Niagara Falls Air Reserve Station.

CAUTION: ANY ACT OR ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL(S) TO THE FULLEST EXTENT PERMITTED BY LAW.

12. CHOICE OF LAW AND JURISDICTION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or winners, Sponsor, and administrator in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of New York State, without giving effect to any choice of law or conflict of law rules or provisions (whether of New York State or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the New York State. Any action seeking legal or equitable relief arising out of or relating to the Promotion or these Official Rules shall be brought only in the courts of the New York or the United States District Courts of New York.

13. TAX INFORMATION: All federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner.

14. WINNERS LIST/OFFICIAL RULES: To receive a list of winners, send a self-addressed stamped #10 envelope for receipt by September 1, 2007 to: “Win a Ride of a Lifetime on a War Bird”, 1780 Wherle Drive, Williamsville, New York 14221.
